17. Release and Covenant Not to Sue

A. Release. To the fullest extent permitted by applicable law, and in consideration of the commitments in this Privacy Policy, you (on behalf of yourself and your heirs, assigns, and representatives) release and forever discharge the Carpet Guys and its affiliates, officers, employees, and agents from any and all claims, demands, causes of action, damages, liabilities, costs and expenses arising out of or relating to the collection, use, disclosure, retention, or protection of personal information to the extent the Company’s conduct is in material compliance with this Privacy Policy. 

B. Covenant Not to Sue. You further covenant and agree not to sue or otherwise assert any claim described in Section 17(A) against the Company with respect to activities that are in material compliance with this Privacy Policy.

C. Carve-Outs. Nothing in this Section limits or waives any claim or remedy to the extent it arises from: (1) the Company’s gross negligence; (2) willful misconduct or intentional disregard of this Privacy Policy; or (3) any non-waivable rights or remedies you may have under applicable law. 

18. Binding Arbitration. You agree to resolve all disputes, claims, or controversies between us arising out of or relating to the terms of this Privacy Policy through binding individual arbitration, subject to any non-waivable rights under applicable law. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. For the avoidance of any doubt, you agree to waive the right to a jury trial to the fullest extent permitted by law. You further agree that any claim arising out of or relating to this Policy or our privacy practices that is not otherwise released through this Policy must be filed within one (1) year after the cause of action accrues, or be permanently barred, except where a longer period is required by law.  

19. Governing Law and Waiver of Class Actions. This Privacy Policy and any dispute relating to our privacy practices are governed by the laws of the State of Michigan, excluding its conflicts-of-law rules. YOU AGREE THAT ANY CLAIMS BROUGHT AGAINST COMPANY ARE IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS ACTION MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.
